Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Barrq, a product operated by BARRQ AI (“Barrq”, “we”, “us”). By creating an account or using the service, you agree to these Terms on behalf of yourself and the business you represent.

1. The service

Barrq is an AI agent platform that helps businesses sell, recover, and grow on WhatsApp, including messaging, catalog, orders, automation, and analytics features.

2. Accounts & eligibility

You must provide accurate information and be authorized to bind your business. You are responsible for activity under your account and for keeping your credentials secure.

3. Free trial & billing

  • New accounts start with a 7-day free trial, no credit card required to begin.
  • Paid plans are billed through our payment provider on a recurring basis until cancelled.
  • Fees are non-refundable except where required by law. You can cancel at any time; access continues through the end of the paid period.
  • We may change plan pricing with reasonable notice.

4. Acceptable use

You agree not to:

  • Send spam, unsolicited, or unlawful messages, or violate recipients’ consent requirements.
  • Infringe intellectual property or privacy rights.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the service.
  • Use the service to sell prohibited or illegal products.

5. Messaging compliance

You are responsible for complying with WhatsApp, and Meta platform policies, and with applicable messaging and consumer-protection laws. You must obtain and maintain valid opt-in from the customers you contact.

6. Your data & responsibilities

You retain ownership of your business and customer data. You grant Barrq the rights needed to process that data to provide the service. You are responsible for the accuracy and lawfulness of the data and content you upload.

7. Intellectual property

Barrq and its software, design, and trademarks are owned by us. These Terms do not grant you any right to our intellectual property except the limited right to use the service.

8. Third-party services

The service integrates with third parties (e.g. Meta, payment, and AI providers). Your use of those services is subject to their terms, and we are not responsible for their availability or actions.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not guarantee specific business results.

10. Limitation of liability

To the maximum extent permitted by law, Barrq will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid in the 12 months preceding the claim.

11. Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms or to protect the service. Upon termination, your right to use the service ceases.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the product or by email. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the applicable laws of the jurisdiction in which Barrq operates, without regard to conflict-of-law principles.
